שאלה בדין ריוח סתומה בתפלין

הכ"ף פשוטה בסוף השיטה ענקית - אמנם נראה שמבחינת צורת האות היא כשרה, אך יש להסתפק שמא הוא מפסיק את הריוח שלאחר ובשעריך. שהרי כעת הריוח אינו פתוח לסוף השיטה. או לאידך שמא נעשה בעצם כאן פרשת סתומה במקום שאינה צריכה להיות פ' סתומה?
אמנם מדובר בתפלין של ראש שלדינא אינו מעכב בה צורת הפרשיות פתוחה וסתומה [וכמו כן יש לומר - אם הניח ריוח פ' סתומה במקום שאינה צריכה].

  2. It's 4 lines so it would be a shel rosh.
    The rosh and regel of the chaf can be shortened. Causing a kuba/zanav isn't an issue here. I'm only aware of Rav Stern who is choshesh that the purposely indented (last) line is included but leshitaso each line needs to be indented more than this 2nd to last line would be intended plus lechora he holds like his rebbi that 3 lines need to be indented and there'd only be 2 here. Rav Elyashiv only requires 2 of the lines to be indented and only the width of a yud but he holds the purposely indented line (due to the shiur parsha) is not included so it's not an issue according to him either.

  3. If thats a (4 line) shel rosh then there would be much bigger problems, namely that the first half of the parsha is missing! It's the last 3 lines of a 7 line shel yad that was cropped to emphasise the problem at the end.

    As a shel yad, the importance of the shiur parsha is much greater than a rosh, because it is on the same piece of parchment. So my question to Reb Moshe is, now that it's a yad, what are the halachic ramifications?

    because there is a extra parsha stuma.

  6. no. the area between the chaf and bi'sheracha is a stuma.

  7. There are Poskim that say letters from the line above will be mimaet the sheur parsha, does anyone say it makes it a stuma?

  8. The Noda Beyehuda, in end of his teshuva about the backwords "nun"s is worried that the nun will make the sheur parsha too small, he does not seem concerned that the nun will make it in to 2 stumos in stead of one

  9. Perhaps the spaces between the words and the inverted Nuns are too small to be concerned about a 2nd shiur parsha?

  10. He says to leave 2 or 3 letters space after the nun, that would be a parsha like R"T, that doesn't seem to bother him, I would think the poskim- who lechatchila are choshesh for R"T- would say to leave only 2 and not 3.

  11. In Shevett Hakehasi (i think vol 5 teshuva 40) Rav Shamai seems to be makil in a slimier case

    Poskim bring that if klaf of stuma has hole-the stuma is not recognizable and it is posul.
    1)If there would be a hole only in place of that regel chaf pshuta would it intercept the stuma
    2) the lashon haposkim is always the seeming intention of the Sofer to make a psucha or a stuma which in our case is clear.
