Shin Lacking a Top

What do you think of the shin of 'asher' in the middle of this picture. Is there a top to the shin? If it is a problem, may it be corrected?

    שמעתי שיעור מרב וואזנער שליט"א שהאות צריך להיות לו ראש ורגל. ואפילו אם אין ניכר היכן מתחיל הראש ונגמר הרגל, מ"מ כיון שניכר בדרך כלל שיש לו ראש ורגל הרי זה כשר. לפי זה, בציור זה לא ניכר בו ראש ורגל אלא קו משוך בשוה, ולכן הרי זה פסול.

I recently tried this kosher ink for my rapidograph and I am extremely pleased with it. It does not clog the nib like other kosher rapidograph inks, and it's very dark and strong. It's at least as good as the Rotring commercial grade rapidograph inks (of course these can only be used with batch numbers that have been lab tested and  approved kosher),  and in addition you do not need to add a drop of regular Sta"m ink (as per the instruction of the Shevet Halevi, which is messy and time consuming).  I was wondering if anyone else had an opinion or comments with regards to their experience with this ink...

Ink, Kosher vs. non-Kosher

We all know that there is no ancient source that requires ink to be מן המותר בפיך . Possibly, as said here before, because in the olden days ink was always  מן המותר בפיך and the question was never raised. It was probably self-evident. Nowadays, no decent Rav will approve an ink which is not מן המותר בפיך  . Who was the first one to raise this question? Was it raised because of animal ingredients or because of non-kosher wine?
